Offenders Required to Register: All adult offenders and certain juvenile offenders convicted of certain sex offenses and crimes against children after 1956 and released on parole or probation are assigned a tier level and subject to community notification dependent upon the assigned tier level and age of the victim.
Information Collected: Record of registration, finger/palm prints, photograph, new address or updated information and a DNA sample if it has not already been taken.
Administrating Agency: Department of Public Safety/Local law enforcement.
Timeframe for Registration: Within 48 hours of arrival in a county; 3 days of changing address, name, employment or student status, within 48 hours of moving into State and prior to leaving the state.
Applies to Out of State Offenders: Yes
Duration of Requirement: Tier 1  offenders 15 years, but may petition the District Court in the jurisdiction where they live for relief of  the duty to register after 10 years of consecutive registration, Tier 2 offenders must register for 25 years with no relief, Tier 3 offenders must register for life. Tier 2 juveniles must register for 25 years, Tier 3 juveniles must register for life with possible relief after 25 years. There is no provision in statute to appeal an assigned Tier Level.
Verification of Address: Verifications of registration are submitted by Tier 1 offenders annually, Tier 2 offenders every 180 days and Tier 3 offenders every 90 days.
Penalties for Non-Compliance: First offense Category D felony, second offense within 7 years Category C felony.
Access to Information: All Tier 1, 2 and 3 offenders with child victims are subject to community notification on the public website. Tier 1 offenders with adult victims are not subject to community notification. Local law enforcement may provide information obtained from the Sex Offender Registry to schools, religious organizations, youth organizations, public housing authority where a sex offender resides, is a student or worker, agencies that provide child welfare and volunteer organizations that have contact with children. If the offender is a Tier 3 any member of the public who is likely to encounter the sex offender.
Confidentiality Provision: It is illegal to use information obtained through this web site to commit a crime against a registered sex offender or to engage in discrimination or harassment against a registered sex offender.  Anyone who uses this information to commit a criminal act against another person is subject to criminal prosecution and/or civil action.
